Mediation

What is mediation?

A means of resolving disputes outside of the judicial system by voluntary participation in negotiations structured by agreement of the parties and usually conducted under the guidance and supervision of a trained intermediary (Mediator/Facilitator)

How does mediation work?

The parties and the neutral facilitator enter into an agreement to bargain in good faith. The mediator does not offer legal advice or solutions for the parties in dispute. The communication of mediation is confidential, unless the communication is required to be disclosed by statute, i.e., the threat to commit a felony. The neutral facilitator guides the parties through conversation until the root of the dispute is lifted and the interests are revealed. The parties will collaborate on creating solutions to resolve their issues and satisfy their interests. If the parties wish, the mediator shall assist them in scribing their words into an agreement called a Memorandum of Understanding.

How much does mediation cost?

In the state of Colorado, fees can range from $150- $500 per hour depending on expertise and demand.

With or without attorneys, a divorce mediator can help you and your partner to navigate the process of divorce and the contention of parting ways. The collaborative, facilitative, interest-based mediator empowers you both to decide your family’s future. Mediation Training

What do you need to become a mediator in Colorado?
  • Complete a 40-hour comprehensive mediation training program, Such as the one offered by Phoenix Strategies, 40-Hour Basic Mediation (phoenixstrategiescolorado.com)
  • Becoming a Professional Mediator
  • There are many opportunities for up and coming mediators to attain the required experience, as a graduate of the Basic Mediation Course you will be well positioned to take advantage of these opportunities.
  • Complete a requisite amount of continuing education, training, and experience every year
  • 10 hours of continuing training and education every year. Training and education includes conferences, seminars , lectures, workshops and training with the primary purpose of providing mediation, negotiation, and/or conflict resolutions skills and knowledge.

Beyond these requirements from the Mediation Association of Colorado, A mediator should possess optimism, trustworthiness, patience, confidence, curiosity and commitment.

What is the median salary of a mediator in Colorado?

About the Book
